Trading Conditions
General Provisions
- Any reason the insured shall have recourse is against the insurers only. The Company shall not be under any responsibility or liability in relation thereto.
- A sum at the rate of Dirhams 30/- per kilo of the gross weight of the goods, subject to a limit of Dirhams 20,000 per package.
Section I – Terms and Conditions
1. Scope of Business
- All business, including advice, information, or services provided (gratuitous or not) by The JBC (hereinafter called “the Company”), is subject to these conditions.
- All other terms are excluded. Special arrangements are possible only if reduced to writing and signed by a director. No agent or employee can waive or vary these conditions.
2. Role of the Company
- The Company is a forwarding agent.
- Except as described in Sections II and III, it acts solely as an agent for performing and securing services for the customer.
- The Company is not a carrier, and does not contract for carriage, storage, packing, or handling of goods with the customer.
3. Authority to Enter Contracts
- The Company may enter into contracts for:
- Carriage of goods by any route or means.
- Lifting and installation of equipment or other goods.
- Storage, packing, or handling of goods at any place or for any duration.
- Any acts necessary or incidental thereto, even if it departs from customer instructions when in the customer’s interest.
4. Customer Authorization
- The customer authorizes the Company to act as above and be bound by such contracts.
- Any terms implied by local law or custom also apply.
5. Customer Warranty
- The customer warrants are the owner or authorized agent of the owner of the goods.
- The customer accepts these conditions on behalf of all parties interested in the goods (“the Owner”).
6. Performance by Others
- The Company may perform obligations itself, via parent/subsidiary/associated companies, or other forwarding agents.
- These companies are entitled to the benefit of these conditions. The customer cannot impose greater liability on them.
Section II – Principal Contracts
- When acting as principal, the Company is not the carrier, packer, or warehouseman.
- The Company benefits from all exceptions and limitations in contracts with carriers.
- Conditions 3 and 5–22 apply to this Section.
Section III – Company as Carrier
- The Company may carry out carriage, storage, packing, or handling itself or via subsidiaries.
- The Company may: Carry goods by any route or means; store, pack, or handle goods at any place/time and depart from instructions if necessary.
- Conditions 3 and 5–22 apply.
- If deemed a carrier by law, the Company has all rights, immunity, exceptions, and limitations under such legislation.
Section IV – Miscellaneous
- Any matter determined by the Company’s opinion is conclusive if certified by a director.
- These conditions and related contracts are governed by the laws of the United Arab Emirates. All disputes fall under the exclusive jurisdiction of UAE courts.
